1. Acceptance of Terms
By accessing and using the TulsaCrete website (tulsacrete.com) or engaging our services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, you should not use our website or services.
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and TulsaCrete regarding your use of our website and the services we provide.
2. Description of Services
TulsaCrete provides concrete contracting services including but not limited to:
- Concrete driveway installation, repair, and replacement
- Patios, sidewalks, and walkways
- Pool decks and decorative concrete
- Garage floors and foundations
- Commercial concrete projects
- Asphalt repair and maintenance services
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.
3. Estimates and Pricing
Free Estimates
TulsaCrete provides free estimates for most residential projects. Estimates are valid for 30 days from the date of issuance unless otherwise specified. After 30 days, we reserve the right to adjust pricing based on material cost changes.
Pricing Accuracy
Our estimates are based on:
- • Information provided by the customer
- • Site visit observations (when applicable)
- • Current material and labor costs
- • Standard installation practices
Additional charges may apply for: unexpected site conditions, soil remediation, permit fees, changes to project scope, or unforeseen complications discovered during construction.
Scope of Work
The accepted estimate/contract defines the scope of work to be performed. Any additional work not included in the original scope will require a change order signed by both parties before work begins.
4. Payment Terms
Standard Payment Schedule
Payment Methods
We accept the following payment methods:
- • Cash, Check, and Money Orders
- • Credit Cards (Visa, MasterCard, American Express, Discover)
- • Bank Transfers (ACH)
- • Financing options through third-party lenders (upon approval)
Late Payments
Payments not received within 10 days of due date may be subject to a late fee of 1.5% per month (18% annual). Failure to make payment may result in work suspension, and the customer shall be responsible for all collection costs including attorney fees.
5. Warranty
Our Warranty
TulsaCrete warrants workmanship for a period of one (1) year from the date of substantial completion. This warranty covers defects in installation craftsmanship.
Material warranties are provided by the respective manufacturers and are passed through to the customer.
Warranty Exclusions
This warranty does NOT cover:
- • Normal wear and tear
- • Damage caused by improper maintenance
- • Cracking due to soil settlement, root intrusion, or environmental factors
- • Damage from heavy vehicles or equipment not specified in the design
- • Acts of nature (floods, earthquakes, extreme weather)
- • Damage caused by third parties
- • Concrete color variations due to natural material differences
- • Surface imperfections that do not affect structural integrity
Warranty Claims
To file a warranty claim, contact us in writing at info@tulsacrete.com or call (918) 520-3823. We will inspect the property within 10 business days and respond regarding coverage. Warranty claims do not extend the original warranty period.
6. Customer Responsibilities
As a customer, you agree to:
- Provide accurate information about the project site and conditions
- Obtain necessary permits (unless we agree to handle them)
- Ensure access to the work site at scheduled times
- Remove vehicles, obstacles, and personal property from work areas
- Provide adequate water access for construction
- Inform neighbors of construction activities when appropriate
- Make timely payments according to the payment schedule
7. Limitation of Liability
IMPORTANT: This section limits our liability to you. Please read carefully.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TULSACRETE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO OUR SERVICES, INCLUDING BUT NOT LIMITED TO:
- • Loss of profits or revenue
- • Loss of use or productivity
- • Cost of substitute services
- • Property damage (beyond our insurance coverage)
- • Inconvenience or disruption to business
Our total liability for any claim arising from our services shall not exceed the total amount paid by you for those specific services.
9. Intellectual Property
All content on the TulsaCrete website, including text, graphics, logos, images, videos, and software, is the property of TulsaCrete and is protected by United States and international copyright laws.
You may not reproduce, distribute, modify, display, or use any content from our website without our prior written consent.
10. Third-Party Links
Our website may contain links to third-party websites, services, or resources that are not owned or controlled by TulsaCrete. We are not responsible for the content, privacy policies, or practices of any third-party sites. Your use of third-party sites is at your own risk.
11. Termination
Either party may terminate this agreement under the following circumstances:
- • By Customer: May terminate at any time for convenience, with written notice. Down payment is non-refundable for work already commenced.
- • By TulsaCrete: May terminate if customer fails to make payment, provides false information, or breaches these terms. In such cases, customer remains liable for work completed.
13. Changes to These Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after such changes constitutes acceptance of the new terms.
